TERMS OF USE

for the website cncexperte.eu – ABARAD® CNC workshops in Europe

Section 1 Scope

(1) These Terms of Use apply to any use of the website https://cncexperte.eu, operated by Krisztián Molnár, ABARAD.eu, Grauwiesen Straße 17, 73569 Eschach, Germany (hereinafter "we"). They apply to visitors as well as to listed workshops and helpers.

(2) Listed workshops are additionally subject to our General Terms and Conditions (https://cncexperte.eu/en/terms/). In the event of any conflict, the General Terms and Conditions prevail.

Section 2 Use of the website

(1) The map and the directory can be used free of charge without logging in. They serve to find CNC workshops and to make business contacts.

(2) In particular, it is prohibited:

a) to extract, copy or transfer the content of the directory into one's own databases by automated or systematic means (scraping, crawling, harvesting), except for normal indexing by search engines;

b) to use the workshops' contact details for unsolicited advertising, to compile address lists from them or to pass them on to third parties;

c) to circumvent security measures, to gain unauthorised access to protected areas or to use other people's login details;

d) to overload the website or impair its functioning through automated requests, malware or other measures.

(3) In the event of breaches, we may block access to the website in whole or in part.

Section 3 Content of the workshops

(1) Each workshop is solely responsible for its listings, profile pages, machine details, images and news. We do not adopt this content as our own.

(2) Workshops may not publish content that

a) is untrue or misleading,

b) infringes applicable law, in particular competition, criminal or youth protection law,

c) infringes copyright, trade mark or other intellectual property rights of third parties,

d) contains personal data of third parties without authorisation,

e) is insulting, discriminatory or degrading,

f) is unrelated to the subject of the directory, in particular pure advertising for other parties' offers.

(3) Images may contain metadata, such as the location where they were taken (GPS data). We recommend removing such metadata before uploading.

(4) Private keywords are not public. Results of the search function in the workshop area may be used only for initiating business cooperation and may not be passed on to third parties.

Section 4 Helper area

(1) The helper area (https://cncexperte.eu/segito/) is not public. Access is set up only by us, by invitation; there is no entitlement to it.

(2) Helpers appear to other helpers only under their nickname. Posts on the idea wall and in comments must be objective and must not infringe the rights of third parties. Content from the helper area, in particular other helpers' ideas, may not be disclosed outside it.

(3) We may delete posts and end a helper's access at any time. When access is deleted, all of that helper's posts and messages are deleted.

Section 5 Reporting illegal content

(1) You can report illegal content to us at any time by email to info@cncexperte.eu. The notice should contain:

a) a sufficiently substantiated explanation of why you consider the content illegal,

b) the exact location, in particular the full web address,

c) your name and email address, unless the notice concerns certain criminal offences under Article 16(2)(c) DSA,

d) a statement that you believe in good faith that the information provided is accurate and complete.

(2) We confirm receipt of the notice, review it in a timely, diligent and objective manner and inform you of our decision (Article 16 DSA). If we remove or block content, we inform the workshop concerned and give our reasons (Article 17 DSA). Both sides may raise objections to our decision by email; we will then review it again.

(3) Where manifestly unfounded notices are submitted repeatedly, we may, after a prior warning, refrain from processing them for a reasonable period (Article 23 DSA).

Section 6 No warranty

(1) We check the workshops' details only to a limited extent, in particular the VAT identification number. We give no warranty as to the accuracy, completeness or currency of the details, the capabilities of the workshops or the conclusion of any business.

(2) Locations on the map are derived from the addresses and may be inaccurate. Distances are straight-line distances and are given for guidance only.

(3) There is no entitlement to constant availability of the website.

(4) Liability towards listed workshops is governed by Section 8 of the General Terms and Conditions. Otherwise, we are liable without limitation only for intent and gross negligence and for injury to life, body or health; in the case of slight negligence we are liable only for breach of an essential obligation and only up to the foreseeable, typical damage. Liability under the German Product Liability Act remains unaffected.

Section 7 Intellectual property

(1) The design, texts and database of the website are protected by copyright. The workshops' content remains their property.

(2) ABARAD® is a registered EU trade mark (EUIPO registration number 016135031) of Krisztián Molnár. Its use requires our prior consent.

Section 8 External links

The website contains links to third-party websites, in particular those of the listed workshops. The respective provider is solely responsible for their content.

Section 9 Changes, governing law, language versions

(1) We may amend these Terms of Use with effect for the future. For listed workshops, the procedure under Section 10 of the General Terms and Conditions applies. Otherwise, the version published on the website applies.

(2) The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

(3) These Terms of Use are available in German, Hungarian and English. Only the German version is legally binding; the Hungarian and English versions are provided for information.
