Terms
GENERAL TERMS AND CONDITIONS
for listings in the directory cncexperte.eu – ABARAD® CNC workshops in Europe
Last updated: November 2026 (Stand: November 2026)
Section 1 Scope, provider
(1) These General Terms and Conditions apply to all contracts concerning the listing of a workshop in the directory and on the map at https://cncexperte.eu, and to the related services, between
Krisztián Molnár, ABARAD.eu, Grauwiesen Straße 17, 73569 Eschach, Germany, email: info@cncexperte.eu (hereinafter the "Provider" or "we")
and the listed business (hereinafter the "Partner").
(2) Our service is aimed exclusively at entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB), that is, natural or legal persons or partnerships with legal capacity acting in the exercise of their trade, business or profession when concluding the contract. We do not enter into contracts with consumers. A statutory consumer right of withdrawal therefore does not apply.
(3) Any deviating, conflicting or supplementary terms and conditions of the Partner do not become part of the contract, even if we do not expressly object to them.
(4) Our Terms of Use (https://cncexperte.eu/en/terms-of-use/) apply in addition and form part of this contract. In the event of any conflict, these General Terms and Conditions prevail.
Section 2 Services
(1) We operate a directory of CNC workshops in Europe with a map view. A Partner's listing comprises the display on the map of the company name, country, location, specialties and, where provided, website and phone number.
(2) At the Partner's request, we may set up access to the workshop area ("Kezelő" access). It comprises in particular a public profile page with address, description, machines and news, the maintenance of these details by the Partner, private keywords and a function for searching other listed workshops. There is no entitlement to such access.
(3) The listing and the workshop area are currently free of charge. We reserve the right to offer additional paid services in future. Such services are provided only on the basis of a separate, express agreement; without such an agreement the Partner incurs no costs. The free listing will not be converted into a paid service without the Partner's consent.
(4) We do not broker orders and do not become a party to any transactions concluded between Partners or between Partners and third parties. We do not owe any particular result, such as a minimum number of enquiries.
(5) We endeavour to keep the website available with as few interruptions as possible, but we do not guarantee availability. Maintenance, security measures and disruptions beyond our control may lead to temporary restrictions. We may develop the service further in technical and design terms, provided that the core of the listing is preserved.
Section 3 Application, review and conclusion of the contract
(1) The Partner applies using the application form on the website. The presentation of the directory is not a binding offer; the application is the Partner's offer to conclude the listing contract.
(2) The Partner confirms its email address via the link we send by email. The link is valid for 48 hours. Unconfirmed applications are deleted.
(3) We review every confirmed application personally, in particular the VAT identification number via the European Commission's VIES system. There is no entitlement to be listed. We may reject an application without giving reasons.
(4) The contract is concluded when we accept the application and activate the listing on the map. No user account is created on acceptance; this is done only at the Partner's request under Section 2(2).
(5) The Partner warrants that the application is submitted by the managing director or owner personally or on their behalf, and that the details provided are complete and correct.
Section 4 Partner's obligations
(1) The Partner keeps its details up to date and informs us of any changes without undue delay, unless it can change them itself in the workshop area.
(2) The Partner is responsible for all content it sends to us or publishes in the workshop area, in particular texts, images, machine details and news. The content must be true, must not be misleading, and must not infringe applicable law or the rights of third parties, in particular copyright, trade mark, competition, personality or data protection law. The Partner may publish personal data of third parties, such as pictures of employees, only if it is entitled to do so.
(3) The Partner keeps its login details secret and protects them against access by third parties. If it has reason to believe that unauthorised persons have obtained them, it informs us without undue delay.
(4) The Partner may use information about other workshops obtained through the search function of the workshop area only for initiating business cooperation. It may not extract such information systematically, pass it on to third parties or use it for unsolicited advertising.
(5) The Partner indemnifies us against all claims asserted against us by third parties on account of an infringement of their rights by content provided by the Partner or on account of any other breach of duty by the Partner. This includes the costs of an appropriate legal defence, including statutory fees. The indemnity does not apply where the Partner is not responsible for the breach.
Section 5 Rights of use
(1) The Partner grants us a simple (non-exclusive), territorially unrestricted, royalty-free right, limited to the term of the contract, to store, reproduce and make publicly available on the website the content it provides (texts, images, logos, machine details, news) and, where technically necessary for display, to adapt it (for example to adjust the size and format of images).
(2) The Partner warrants that it holds the rights required for this.
(3) We may use the Partner's company name only within the directory. Any use for reference or advertising purposes outside the directory requires the Partner's prior consent.
Section 6 Removal and blocking of content
(1) We are entitled to remove the Partner's content in whole or in part, to disable access to it and to hide the listing temporarily if there are concrete indications that the content is illegal or breaches these General Terms and Conditions or the Terms of Use.
(2) We inform the Partner of any such measure and the reasons for it in accordance with Article 17 of Regulation (EU) 2022/2065 (Digital Services Act), unless legal reasons prevent this. The Partner may object to the measure by email to info@cncexperte.eu; we will review the objection and inform the Partner of the outcome.
(3) We handle notices from third parties about illegal content in accordance with Article 16 DSA in a timely, diligent and objective manner. Details are set out in the Terms of Use.
Section 7 Term and termination
(1) The contract is concluded for an indefinite period.
(2) The Partner may terminate the contract at any time without notice. An email to info@cncexperte.eu is sufficient. We will then remove the listing promptly.
(3) We may terminate the contract with two weeks' notice. The right to terminate without notice for good cause remains unaffected. Good cause exists in particular if the Partner seriously or, despite a warning, repeatedly breaches these General Terms and Conditions or the Terms of Use, has provided false information or is not an entrepreneur within the meaning of Section 14 BGB.
(4) If we discontinue the directory as a whole, we will terminate with one month's notice.
(5) Termination must be made in text form (Section 126b BGB).
(6) When the contract ends, we delete the listing and all associated content, including the workshop account, unless statutory retention obligations prevent this.
Section 8 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act, in the event of fraudulent concealment of a defect and to the extent of any guarantee we have given.
(2) In the event of a slightly negligent breach of an essential contractual obligation, our liability is limited in amount to the damage typical for the contract and foreseeable at the time the contract was concluded. Essential contractual obligations (cardinal obligations) are obligations whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the Partner may regularly rely.
(3) Otherwise, our liability for damage caused by slight negligence is excluded.
(4) The above limitations of liability also apply in favour of our legal representatives and vicarious agents.
(5) We are not responsible for the content of other Partners or for third-party websites to which links are provided. The Partner is itself responsible for keeping its own copies of the content it provides.
Section 9 Data protection
We process personal data in accordance with our Privacy Policy (https://cncexperte.eu/en/privacy/).
Section 10 Changes to these General Terms and Conditions
(1) We may amend these General Terms and Conditions with effect for the future if there is a valid reason, in particular changes in legislation or case law, technical changes to the service or the introduction of new services. We will not change the essential elements of the contract, in particular the fact that the listing is free of charge, without the Partner's consent.
(2) We notify the Partner of changes in text form at least four weeks before they take effect. If the Partner does not object in text form within this period, the changes are deemed accepted. We will expressly point out the period, the right to object and the consequences of silence in the notification. If the Partner objects, either party may terminate the contract with effect from the date on which the change would take effect.
Section 11 Final provisions
(1) The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) If the Partner is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, or has no general place of jurisdiction in Germany, the exclusive place of jurisdiction for all disputes arising from this contract is our place of business. We are also entitled to bring an action at the Partner's general place of jurisdiction.
(3) Should any provision of these General Terms and Conditions be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision is replaced by the statutory provisions.
(4) These General Terms and Conditions are available in German, Hungarian and English. Only the German version is legally binding; the Hungarian and English versions are provided for information.
